PriorWrittenAgreement.com makes it easy for a licensed Title Agent in Texas to place a PWA with a Co-opting Title Agent in a County they are not licensed. After completing the PWA request and clicking submit the Prior Written Agreement request is sent directly to the proposed Co-opting Title Agency. Background: Title Agents in Texas are licensed on a County by County basis. When purchasing Title Evidence and/or Title Evidence & Examination in a County where they are not licensed they are required to follow Texas Department of Insurance Procedural Rule 24 aka P-24. Licensed Title Agent are required to have a “Prior Written Agreement” in place with Co-opting Agents at least ninety days prior the closing of a transaction. Otherwise, the premium split between the two agents is based strictly upon a P-24 split (50/50 if greater than $125K). Assuming a Co-opting Agent may be willing to provide Title Evidence at a better price (or a lesser split) the requesting Agents must a have a Prior Written Agreement in place 90-days prior to the closing of the transaction.
